Wareham District Court and the Cape Cod Gateway

Wareham District Court at 2200 Cranberry Highway serves Wareham, Middleborough, Carver, Lakeville, and other towns in the southern part of the county. Wareham District Court processes a high volume of seasonal traffic cases and serves as the court of record for citations issued across the Cape Cod gateway area of Plymouth County.

Civil and Criminal Traffic Offenses

Massachusetts law splits traffic cases into civil and criminal. Most tickets are Civil Motor Vehicle Infractions, or CMVIs, under MGL Chapter 90C. These include speeding, failure to yield, running a stop sign, and other common moving violations. CMVIs are not crimes. You have three options: pay the ticket and accept the violation, request a clerk-magistrate hearing within 20 days, or do nothing and have the ticket default against you.

Criminal traffic offenses fall under MGL Chapter 90. Operating under the influence is the most common. OUI specifically is covered under Chapter 90, Section 24. Reckless driving, negligent operation, and leaving the scene of an accident are also criminal. These cases go through arraignment, not the clerk-magistrate hearing process used for CMVIs.

The clerk-magistrate hearing costs $25. If the clerk rules against you, you can appeal to a judge for $50. At the judge-level hearing, the issuing officer must be present. Plymouth County Superior Court

Plymouth County Superior Court shares the Obery Street address with Plymouth District Court. Superior Court handles criminal traffic cases that are indicted, as well as appeals from district court criminal convictions that require a new trial. Most traffic cases never reach the superior court level. The path there involves either a criminal indictment or a formal de novo appeal from a district court criminal conviction.

Paying a Plymouth County Traffic Ticket

You can pay a ticket online through the official Massachusetts ticket payment page.
