Barnstable District Court sits at the mid-Cape and handles the bulk of traffic cases. Falmouth District Court serves the southwestern part of the peninsula. Orleans District Court covers the outer Cape, including Eastham, Wellfleet, Truro, and Provincetown.

All traffic records from these courts are available through the MassCourts public portal. You can look up civil motor vehicle infractions and criminal traffic cases by name, date of birth, or docket number. Access is free. You do not need to create an account to run a basic search.

Barnstable County Traffic Citations: CMVIs and Criminal Cases

Massachusetts splits traffic offenses into two main categories. Civil Motor Vehicle Infractions (CMVIs) are the most common. These include speeding, running a red light, failure to stop, and similar violations. Note: Speed limits on Massachusetts roads are set under Chapter 90, Section 17 and local ordinances. Cape Cod roads often have lower posted limits due to pedestrian activity and narrow lanes in summer.

How to Pay or Appeal a Barnstable County Traffic Ticket

When you get a traffic ticket in Barnstable County, you have a few options. You can pay it, request a clerk-magistrate hearing, or appeal to a judge. The path you choose depends on whether you want to contest the violation.

To pay your ticket online, visit the official Massachusetts ticket payment page. You can also pay by mail using the envelope attached to your citation, or in person at the relevant district court clerk's office. Paying means you accept the violation. Points will be assessed to your driving record under the Safe Driver Insurance Plan (SDIP), which can raise your insurance rates.

If you want to fight the ticket, you must request a hearing within 20 days of the citation date. Miss that window and your options narrow. The first step is a clerk-magistrate hearing, which costs $25. This is an informal proceeding where the clerk reviews the citation and hears your side. You do not have the right to cross-examine the officer at this stage. If the clerk finds against you, you can appeal to a judge for $50. At the judge-level appeal, the issuing officer must appear. If the officer does not show up, the ticket is typically dismissed.

There is no district court on the outer Cape beyond Orleans. If you were cited in Eastham, Wellfleet, Truro, or Provincetown, your case is heard at Orleans District Court. Seasonal Traffic Enforcement in Barnstable County

Cape Cod sees a dramatic increase in traffic volume from late May through Labor Day. Summer months bring hundreds of thousands of visitors onto Route 6, Route 28, and the Mid-Cape Highway. State Police and local departments increase enforcement during this period. Speed traps are more common. Sobriety checkpoints are set up at regular intervals. Moving violations spike in July and August.

For civil infractions, there is no DA involvement. Those cases are handled entirely by the clerk-magistrate or judge at the district court level.

Barnstable County Driving Records and RMV

Your driving record is separate from your court record but closely linked. When you receive a CMVI and pay it or lose a hearing, the Registry of Motor Vehicles (RMV) updates your driving record. Points are added under the Safe Driver Insurance Plan. More points mean higher insurance rates. Some violations trigger automatic license suspension regardless of your point total.

You can request your Massachusetts driving record through the RMV online portal. Standard records cost $20. Certified records for court or employer use cost more. Your record shows violations for the past several years along with any license actions taken.

The nearest RMV service center for most Cape Cod residents is in Hyannis. There is no full RMV branch in Orleans or on the outer Cape. For RMV matters related to license reinstatement after a traffic suspension, you may need to travel to Hyannis or handle the process by mail and online.

Note: If your license was suspended after a traffic conviction, you must pay a reinstatement fee to the RMV before driving again. Driving on a suspended license is a separate criminal offense that carries additional fines and potential incarceration.
