Civil and Criminal Traffic Offenses in Worcester County

Like the rest of Massachusetts, Worcester County splits traffic cases into civil and criminal. Civil Motor Vehicle Infractions (CMVIs) are the most common type. These are non-criminal tickets under MGL Chapter 90C. You can pay a CMVI, request a clerk-magistrate hearing for $25, or appeal a clerk ruling to a judge for $50. The 20-day window to request a hearing starts from the citation date. Miss it and you generally lose the right to contest.

Criminal traffic charges fall under MGL Chapter 90. OUI is the most common criminal traffic charge in the county and is governed by Chapter 90, Section 24. A first OUI offense may qualify for the 24D program, which includes alcohol education and can result in less severe consequences. Other criminal traffic offenses include reckless driving, negligent operation, and leaving the scene of an accident.

At a judge-level CMVI appeal, the officer who issued the ticket must appear. If the officer does not show, the ticket is dismissed. This makes appealing worth considering in many cases. The Massachusetts ticket appeal page and the hearing guide walk through the full process.

Specialty Courts in Worcester County

Several Worcester County district courts operate specialty court programs. Gardner District Court runs a Veterans Treatment Court. East Brookfield, Fitchburg, Orange, and Uxbridge District Courts each operate drug court programs. These programs are designed for defendants with underlying issues tied to their criminal charges, including criminal traffic matters.

The specialty courts department page explains how these programs work statewide. The recovery and drug courts page covers drug court eligibility and referral in detail. These are not options for civil infractions. They apply only to criminal traffic charges where the defendant qualifies. If you are facing an OUI or other criminal traffic charge in Worcester County, an attorney can advise you on whether specialty court is a viable path.

Worcester County Superior Court

Worcester County Superior Court shares the 225 Main Street address with Worcester District Court. The superior court handles criminal traffic cases that are indicted by a grand jury, as well as appeals from district court criminal convictions seeking a new trial. Most traffic cases never reach the superior court. The process involves either a criminal indictment following an arrest on a serious traffic charge, or a formal de novo appeal of a district court criminal conviction.

The Worcester County Superior Court page has current contact and filing details for the superior court clerk's office.

Paying and Contesting Traffic Tickets

To pay a ticket, go to the official Massachusetts ticket payment page. Online payment is the fastest option. Mail and in-person payment at the district court clerk's office are also available. Paying the ticket closes the case but adds points to your RMV driving record under the Safe Driver Insurance Plan. Points can affect your insurance premiums for years.

To contest the ticket, file a hearing request within 20 days. Bring the citation to the clerk's office at the court listed on the ticket, or request the hearing by mail. The clerk-magistrate hearing is informal. The clerk reviews the citation, hears your account, and decides. If the clerk rules against you, you can appeal to a judge for a $50 fee. At the judge hearing, the issuing officer must appear. No officer generally means the ticket is dismissed.

You can request your Massachusetts driving record from the RMV to see current points and violations. If your traffic stop involved an accident, you can also request a police crash report for insurance or legal purposes.

Court Fees and the Massachusetts Court System

The district court filing fees page lists what each filing type costs across the Massachusetts district court system, including Worcester County courts. The standard CMVI hearing fees are $25 for a clerk-magistrate hearing and $50 for a judge appeal. Certified copies of records carry a per-page fee. The Massachusetts court system overview shows how Worcester County's 13 district courts fit into the statewide Trial Court structure.

The Worcester County District Attorney handles criminal traffic prosecutions across the county. The DA's office can be reached at (508) 755-8601. For civil infractions, there is no DA involvement. Those cases are handled entirely within the clerk-magistrate and judge appeal process.
